By using emeraldthinker.com or purchasing from Emerald Thinker Gallery, you agree to these terms, along with our Privacy Policy, Shipping Policy, and Return Policy. If you do not agree, please do not use the site.

Most works we offer are unique originals, and availability is not guaranteed until payment is confirmed. We make every effort to describe and photograph works accurately, but colors may vary slightly between screens and the physical work. If a work becomes unavailable or is listed in error, we may cancel the order and issue a full refund.

Prices are listed in U.S. dollars and may change without notice. Payment is due in full at the time of purchase and is processed securely through Stripe. Applicable sales tax is collected where required. We reserve the right to decline or cancel any order, including orders we suspect to be fraudulent.

All sales are final, except as described in our Return Policy. By completing a purchase, you confirm that you have read and accepted that policy.

Shipping is governed by our Shipping Policy. All shipments are insured for the full purchase value. Ownership of the artwork passes to you once payment is received in full. Risk of loss passes to you upon delivery, or upon pickup if you collect the work in person.

Purchasing a physical artwork does not transfer copyright or reproduction rights, which remain with the artist unless agreed in writing. All images, text, and other content on this site are owned by Emerald Thinker Gallery or the respective artists and may not be copied, reproduced, or used commercially without written permission.

We stand behind the authenticity of the works we sell. If you have questions about authenticity or documentation, contact us and we will address them promptly.

You agree not to misuse the site, including attempting to gain unauthorized access, interfering with its operation, scraping content without permission, or using it for any unlawful purpose.

Our site may link to or rely on third-party services, such as payment processors and carriers. We are not responsible for their content, policies, or practices.

The site is provided “as is” and “as available.” To the fullest extent permitted by law, Emerald Thinker Gallery is not liable for indirect, incidental, or consequential damages arising from your use of the site or purchases, and our total liability for any claim is limited to the amount you paid for the artwork at issue.

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, unless applicable law provides otherwise.

We may update these terms from time to time, and continued use of the site means you accept the updated terms.
