1. Overview
These Terms & Conditions govern your use of emeraldthinker.com (“the Site”) and all services provided by Emerald Thinker, including art sales, digital Certificates of Authenticity, provenance tools, commissions, and related features.
By using the Site, you agree to these Terms. If you do not agree, you may not use the Site.
2. Intellectual Property
All artworks, images, branding, text, design assets, and digital COA systems on this Site are the intellectual property of Emerald Thinker or its represented artists.
You may not reproduce, sell, distribute, mint NFTs, or modify any content without explicit written permission.
Unauthorized reproduction of artwork is strictly prohibited.
3. Product & Service Descriptions
Emerald Thinker sells:
- Original artworks
- Limited edition prints
- Digital Certificates of Authenticity
- Commissioned artwork
- Fine art provenance records
- NFTs or blockchain-backed COAs (where applicable)
We make every effort to accurately represent all products. Colors may vary slightly due to monitor calibration.
4. Ordering & Payments
Payments are processed securely through third-party providers (e.g., Stripe, PayPal).
We do not store credit card information.
Purchases must be completed before artwork is shipped or digital COAs are released.
We reserve the right to cancel orders in cases of suspected fraud or price errors.
5. Shipping & Delivery
We ship worldwide. Delivery times vary by region.
Once a package is accepted by the carrier, Emerald Thinker is no longer responsible for delays or damage not caused by our packaging standards.
If your order arrives damaged, notify us within 72 hours with photographs.
6. Commissions
Commissioned artwork is final sale.
Deposits are non-refundable.
Artist retains all copyrights unless otherwise negotiated.
7. Certificates of Authenticity & Provenance
Digital COAs are issued through the Emerald Thinker Provenance System.
By using the COA portal, you consent to having the following stored:
- Serial number
- Artwork information
- Date of purchase
- Ownership transfer history (private or public depending on medium)
Wallet addresses for blockchain services are stored only as necessary for transaction records.
8. Limitation of Liability
We are not liable for:
- Indirect or incidental damages
- Third-party service errors
- Shipping delays
- Loss or theft of artwork after delivery
- Blockchain network issues
Our total liability will not exceed the purchase price of the artwork.
9. Governing Law
These Terms are governed by the laws of the State of California.
